Terms of Service

These Terms are an agreement between you and PLATINUM POSITIONING, a Pennsylvania partnership ("we," "us," or "our"), for ownyourdms.com, the Own Your DMs software and members area, the AI Setup File, update packs and Own Your DMs Hosting (together, the "Services"). By joining the waitlist, buying or using the Services, you agree to these Terms. If you don't agree, don't use them.
1. Who can buy
You must be at least 18 and able to enter a binding contract. You're buying for your own business.
2. What you get
- Own Your DMs Basic: the software files and members-area videos for the features listed on the sales page when you buy.
- AI Setup File: an instruction file you can give an AI agent to help with setup. You're responsible for reviewing what any AI tool does on your accounts and server.
- Own Your DMs Pro: upgrade packs, instructions and videos for the Pro features listed when you buy.
- Own Your DMs Hosting: a hosting account with Own Your DMs installed, under Section 7.
Access to the members area is delivered right after purchase.
3. License
You may install and run Own Your DMs on as many Instagram accounts as you like, as long as every account is a brand you own or control.
You may not install or run it for clients or anyone else's brand, resell it, give it away, share your download or members-area login, or offer it as a service. An agency license for client work may be offered separately.
You're buying a license to use the software, not the software itself. We keep all rights to the code, videos, files and branding. You may change the code for your own installs. If you break this license, we may end your access to the members area and future updates, and we may pursue other legal remedies.
4. Prices and refunds
Prices are shown at checkout and may change at any time, including during a launch. A lower price at a different time is not grounds for a refund or credit.
All sales are final. There are no refunds. You get access as soon as you buy, and digital files can't be returned. Watch the demo and read the requirements before you buy.
5. What you need, and what's on you
To run Own Your DMs on your own hosting you need cPanel hosting that supports PHP, MySQL and cron jobs, an Instagram professional account and your own Meta developer app. Requirements may change if Meta or hosting providers change theirs.
- You control your server. We don't log into your hosting, cPanel, database, Meta app or Instagram account. You install the software and every update yourself.
- Back up before every change. You're responsible for backups of your files and database.
- Follow Meta's rules. You're responsible for following Meta's Platform Terms, Developer Policies and Instagram's Community Guidelines, for the messages you send, and for any action Meta takes on your app or accounts.
- Follow the law. You're responsible for your own privacy policy, email consent and marketing compliance toward your followers and subscribers.
6. Updates
- Updates are delivered as downloadable packs with written instructions. You install them yourself.
- If you run it on your own hosting, update packs cost $17 each, or $37 a year for every pack released during your paid year, on all your installs.
- New features are delivered as update packs within the tier you own. Basic packs go to Basic owners, Pro packs to Pro owners.
- Stopped-working fixes are free. If Meta changes its API in a way that stops a feature you bought from working, we'll release a fix pack free for all buyers, as long as a reasonable fix exists.
- New channels, such as Facebook Messenger, LinkedIn or YouTube, are separate products and aren't included in any update plan.
- Your dashboard checks once a day whether a newer version is out. It sends no data about your followers or settings.
We don't promise any number of updates, or any particular feature, release date or schedule. Prices for update packs and plans may change, but not during a year you've already paid for.
7. Own Your DMs Hosting
- What it's for. The account runs your Own Your DMs install and nothing else. It includes 400 MB of disk space, no email accounts and no file or video hosting. Uploading other sites, files or downloads isn't allowed.
- Setup. We set up your account within 48 hours of your order. You add your own Meta app details and email tool details.
- Billing. Hosting is billed monthly or yearly at the price shown when you sign up, and renews automatically until you cancel. You can cancel anytime before your next renewal. There are no refunds for partial periods.
- Updates and support. Update packs are included while your hosting is active. You still install them yourself. We support the hosting account itself.
- When it ends. If you cancel or a payment fails, your hosting account and its data may be deleted after it closes. Export anything you want to keep before then.
- Fair use. We may suspend an account that harms the server, other customers or our standing with Meta, our host or the law, including spam, abuse or illegal content.
- Uptime. We work to keep the server running but don't guarantee uninterrupted service. Planned maintenance and outages beyond our control can happen.
8. Support
The members-area videos and written guides are your support for the software. We don't provide one-to-one setup help or troubleshooting for installs on your own hosting. Hosting customers get support for their hosting account.
9. Results and comparisons
Examples, numbers and comparisons on the Site, including other tools' prices, are for illustration and reflect information available when published. Other companies' prices change. We don't promise any number of messages, leads, sales or income. Your results depend on your content, your audience and your effort.
10. Not affiliated
Own Your DMs is not affiliated with, endorsed by or sponsored by Meta Platforms, Instagram or ManyChat. Those names belong to their owners and are used only to describe compatibility and comparisons.
11. No warranty
The Services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Meta can change or limit its API, rate limits or rules at any time, and features may stop working or change because of it.
12. Limit of liability
To the fullest extent allowed by law, we're not liable for indirect, incidental, special or consequential damages, or for lost profits, data, followers, accounts or business, including actions Meta or Instagram takes on your accounts. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You agree to defend and hold us harmless from claims arising from your use of the Services, the messages you send, your content, or your breach of these Terms or Meta's terms.
14. Changes to these Terms
We may update these Terms. Changes are posted on this page with a new date. Using the Services after a change means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute will be resolved by binding arbitration with the American Arbitration Association (AAA) in Pottstown, Pennsylvania, under its applicable rules, on an individual basis and not as part of a class action.
